In order for a foreign national to stay in the Czech Republic for a long period, they must apply for a visa or residence permit. A visa application is submitted at a diplomatic mission of the Czech Republic abroad. But can a foreign national submit an application at any Czech embassy abroad? No! Everything is governed by so-called "local consular jurisdiction".
What Is Local Consular Jurisdiction?
Local consular jurisdiction is a rule that determines which Czech embassy or consulate may accept your visa or residence application for the Czech Republic.
Its purpose is to ensure efficient processing of applications and to enable diplomatic missions to verify facts related to applicants’ residence. At the same time, it prevents situations where applicants would choose embassies solely based on appointment availability.
Where to Submit an Application for a Residence Permit in the Czech Republic?
An application for a visa or residence permit for the Czech Republic is submitted at a Czech embassy in the country:
- which the foreign national is a citizen of;
- that issued the foreign national’s travel document;
- where the foreign national has demonstrably resided for at least 2 years on the basis of long-term or permanent residence permit.
At the same time, there may be multiple diplomatic missions of the Czech Republic in a given country (for example, in the USA, Canada, Turkey, and others). In such cases, it is necessary to verify directly with the embassy or on the embassy’s website that the area where your permanent residence is registered falls under the jurisdiction of that particular embassy.
Submitting a Visa Application at a Czech Embassy Anywhere in the World? Sometimes It Is Possible!
At the beginning, we explained that it is not possible to submit an application for a Czech visa anywhere in the world, because the place of submission is governed by local consular jurisdiction. However, in some cases this is possible.
A special regulation (Decree No. 429/2010 Coll.) sets out a list of countries whose citizens are not required to comply with local consular jurisdiction. In other words, they may submit a visa application at any Czech embassy abroad, provided that the embassy accepts that specific type of visa or residence application.
This includes countries such as Australia, Brazil, Japan, the USA, Canada, South Korea, and many others. The full list can be found here.
Nevertheless, the Ministry of Foreign Affairs recommends submitting applications primarily in the place of permanent residence, where it is usually easiest to provide the necessary documents and fulfill all administrative requirements.
How to Find Out Which Czech Embassy to Submit a Visa Application To?
Not all countries have a Czech embassy or consulate on their territory. In some cases, one diplomatic mission is responsible for several countries at the same time.
Before submitting an application for a visa to the Czech Republic or for long-term residence permit, we recommend verifying:
- which diplomatic mission is competent for your country;
- whether it accepts applications for the required type of residence permit;
- how appointment booking works;
- which documents need to be submitted.
Each diplomatic mission may have a different appointment system, appointment capacity, and specific requirements regarding submitted documents.
Practical Example: Employee Card Application
Let us imagine a citizen of Nepal who has received a job offer from a Czech employer and wants to apply for an Employee Card (“work visa”).
They cannot automatically choose any Czech embassy simply because it offers an earlier appointment. The application must be submitted at the diplomatic mission that is competent for Nepal or for the country in which they legally reside on a long-term basis. In the case of Nepali citizens, the competent Czech embassy is located in India.
By contrast, a Canadian citizen may submit an application for an Employee Card at any diplomatic mission of the Czech Republic that accepts this type of application - not only in their home country, but anywhere in the world.
